SlapYOUniversity Membership Terms and Conditions

These Membership Terms and Conditions (Terms) govern purchases of and access to SlapYOUniversity courses, memberships, consultations, websites, and related materials. SlapYOUniversity is operated by SlapYOU LLC, doing business as SlapYOUniversity (SlapYOUniversity, we, us, or our). By purchasing a membership, creating an account, or accessing the services, you agree to these Terms and any Offer-specific terms presented at checkout.

1 Acceptance and eligibility

You must be at least 18 years old and legally able to enter into a contract to purchase a membership. A parent or legal guardian must purchase and manage the account for an athlete under 18. Minors may participate only with the permission and appropriate supervision of a parent or legal guardian and may not independently submit payment information, consultation requests, training videos, or other personal information.

If you purchase for an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, do not purchase or use the services.

2 Memberships and access

The products, membership level, price, billing frequency, access date, and included features are stated in the applicable Offer and checkout page. Features may differ among Basic, Elite, and All-American memberships. Access begins on the date stated at checkout and continues while the membership remains active and paid, subject to these Terms.

Offer-specific disclosures and any separately signed institutional agreement supplement these Terms. If there is a direct conflict, a separately signed agreement controls first, followed by the Offer-specific checkout terms and then these Terms.

3 License types and permitted audiences

Unless an Institution License is expressly identified in the applicable Offer or written order, the purchase is an Individual or Family License.

Individual or Family License. One account and one set of credentials are provided to the purchaser. The purchaser may view the program with dependent athletes in the same household. A parent or guardian may use the material to train their own dependent child or children. A coach or instructor purchasing an individual membership may apply general knowledge learned from the program in their own instruction, but may not display, distribute, reproduce, or provide clients with access to SlapYOUniversity content. The account may not be used as access for another household, an entire team, or unrelated athletes.

Institution License. One account and one set of credentials are provided for one named school, club, team, or softball program and controlled by one designated coach or program administrator. That account holder may display and use course content during live training with athletes affiliated with the named program. Other coaches and athletes may not independently access the account or receive its credentials. The institution must contact us to change the designated account holder. Use by additional teams, programs, locations, or organizations requires our written permission or an additional license.

Consultation credits and other quantity-limited benefits attach to the purchased membership, not to each person who may view or benefit from the content.

4 Accounts and credential sharing

Login credentials are personal to the authorized account holder and may not be shared, transferred, sold, published, or provided to an unauthorized person. An authorized user may access the platform from multiple personal devices, but simultaneous or repeated access suggesting use by multiple people is prohibited.

We may review reasonable account-access and usage information to protect platform security and investigate suspected misuse. We may require verification or a password reset, temporarily suspend access during an investigation, or terminate access for a material or repeated violation. Contact support@slapyouniversity.com if additional or replacement access is needed.

5 Prices payments and automatic renewal

You authorize us and our payment processor to charge the payment method provided at checkout for the amount and frequency disclosed before purchase, including applicable taxes. Monthly and annual memberships renew automatically until canceled. Renewal charges occur on the scheduled billing date shown in the customer account or applicable purchase confirmation.

We may change renewal pricing by providing reasonable advance notice before the new price applies. If payment fails, we may retry the charge, request an updated payment method, suspend access, or cancel the membership. You are responsible for maintaining accurate billing and contact information.

6 Presale and promotional offers

For the 2026 Founding Member Presale, the initial payment is charged at purchase, course access begins October 15, 2026, and the first paid membership period begins on that access date. A presale monthly membership next renews on November 15, 2026. A presale annual membership next renews on October 15, 2027. These dates apply only when reflected in the purchaser's Kajabi Payments subscription record and purchase confirmation.

Promotional codes, discounts, and special offers are governed by the terms presented with the promotion. A valid code must be entered and successfully applied before payment. Discounts cannot be applied retroactively, combined, transferred, or exchanged for cash unless expressly stated. Unless a promotion says otherwise, the discount applies only to the first payment and later renewals are charged at the regular price disclosed for the membership.

7 Cancellation and refunds

You may cancel at any time through the available customer-account controls or by contacting support@slapyouniversity.com. Cancellation stops future renewal charges and ordinarily takes effect at the end of the current paid billing period. Access continues through that period unless the membership is terminated for breach. To avoid another charge, cancellation must be completed or received before the next scheduled billing date.

Initial purchases may be refunded if a written request is received within seven calendar days after course access begins and the customer has not substantially accessed, completed, or downloaded the program. Substantial use includes completing or accessing more than 10 percent of the included course lessons, bulk access or downloading of materials, or other activity reasonably showing meaningful consumption of the program. Approved refunds return the initial payment through the original payment method.

Renewal payments and unused portions of a current billing period are nonrefundable and are not prorated. Exceptions will be made where required by applicable law. Canceling a membership does not cancel an already-booked consultation or restore a used consultation credit.

8 All American consultation credits

Each All-American membership includes two 30-minute consultation credits per membership year. Consultations are available by phone or video chat, require advance scheduling, and are subject to availability. Once scheduled, a consultation cannot be canceled, transferred, or refunded, and a missed appointment uses one credit. Unused credits expire at the end of the applicable membership year and do not roll over. If SlapYOUniversity must reschedule, the credit remains available.

9 Ownership and intellectual property

SlapYOU LLC and its licensors own all rights in the courses, videos, podcasts, worksheets, graphics, drills, written lessons, trademarks, branding, platform materials, and related content. A membership grants only a limited, revocable, nonexclusive, nontransferable right to access and use the content during the applicable access period. No ownership is transferred.

Except as expressly permitted in Section 3, you may not copy, screen-record, reproduce, republish, upload, transmit, distribute, sell, sublicense, create derivative course materials from, or otherwise exploit the content. You may not provide the content to an artificial-intelligence system, dataset, or model for training, analysis, reproduction, or generation. You may not use our names, logos, branding, images, or likenesses to suggest sponsorship, endorsement, certification, or affiliation without written permission.

Course completion does not authorize anyone to identify themselves as a SlapYOUniversity Certified Instructor. Certification is a separate opportunity with separate eligibility and requirements.

10 Comments communications and submissions

Comments and discussion access are available only where included in the purchased membership. Lesson comments may be visible to other members who can access that lesson. Members must communicate respectfully and may not post harassment, threats, spam, unlawful material, private information, or content that infringes another person's rights. We may moderate or remove content and restrict communication privileges.

If SlapYOUniversity permits members to submit training videos or other materials for feedback, the submitter represents that they own the material or have all required permissions. A parent or guardian must submit or authorize material featuring a minor. We may privately access and use submitted material to provide the requested service. We will not use it publicly for advertising, social media, or promotion without separate permission.

Comments, messages, and consultations are not emergency services or sources of medical care and do not guarantee an immediate response.

11 Safety and assumption of risk

Softball and athletic training involve inherent risks, including contact with bats and balls, falls, collisions, repetitive stress, and other physical injury. Participants voluntarily assume the ordinary risks associated with participation and remain responsible for selecting activities appropriate to their age, ability, health, and environment.

Athletes must follow standard softball safety practices and wear a properly fitted batting helmet at all times while performing hitting, slapping, bunting, pitching-machine, or other ball-contact drills. Participants must use appropriate and undamaged equipment, maintain a safe distance from others, train in a suitable area, and receive qualified adult supervision when appropriate. Pitching machines should be operated only by a responsible adult or qualified coach.

Stop training if pain, dizziness, swelling, illness, or injury occurs and seek advice from a qualified medical professional. SlapYOUniversity provides educational information and does not provide medical care, physical therapy, diagnosis, or individualized medical advice.

12 Educational purpose and no guaranteed results

The services provide general educational and coaching information. Techniques may require adaptation to an athlete's age, health, ability, rules, coaching environment, and circumstances. Results depend on many factors outside our control, including effort, practice, health, coaching, competition, and opportunity.

We do not guarantee playing time, statistical improvement, team selection, recruitment, scholarships, certification, employment, income, or any other specific athletic, academic, or professional result.

13 Third party services and availability

The services may rely on Kajabi, payment processors, video-conferencing platforms, email providers, internet services, and other third parties. Temporary interruptions may occur because of maintenance, outages, security events, or circumstances outside our reasonable control. Continuous, uninterrupted, or error-free access is not guaranteed.

We may update, replace, remove, or reorganize lessons, instructors, features, or supporting materials as the program evolves, provided that the overall paid service is not materially reduced without an appropriate remedy.

14 Suspension termination and discontinuation

We may suspend access for failed payment, security concerns, suspected account sharing, or while potential misuse is investigated. We may terminate a membership for a material or repeated breach, including unauthorized sharing, copying, harassment, fraud, unsafe or unlawful conduct, or infringement of intellectual-property rights. A customer terminated for breach is not entitled to a refund except where required by law.

If we permanently discontinue a paid membership during an active term, we may provide a comparable replacement, continued access for a reasonable transition period, or an appropriate prorated refund.

15 Privacy and electronic communications

Our collection and use of personal information are governed by the SlapYOUniversity Privacy Policy posted on our website. Transactional communications concerning purchases, access, billing, security, consultations, and these Terms may be sent regardless of whether a customer elects to receive marketing messages. Marketing communications are governed by the customer's communication preferences and applicable law.

16 Disclaimers and limitation of liability

To the fullest extent permitted by law, the services and content are provided as available without warranties not expressly stated in these Terms. We do not exclude any warranty, duty, or remedy that cannot legally be excluded.

To the fullest extent permitted by law, SlapYOU LLC and its owners, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the services. Our aggregate liability for a claim will not exceed the amount the claimant paid to us for the affected membership during the 12 months preceding the event giving rise to the claim. These limitations do not apply to liability that cannot lawfully be limited, including liability arising from gross negligence or willful misconduct where applicable.

17 Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless SlapYOU LLC and its owners, employees, contractors, and agents from third-party claims, damages, and reasonable costs arising from your material breach of these Terms, unauthorized use or distribution of the content, infringement of another person's rights, or unlawful conduct. This obligation does not apply to the extent a claim results from our gross negligence or willful misconduct.

18 Informal resolution governing law and venue

Before filing a claim, you agree to contact support@slapyouniversity.com with a written description of the dispute and allow 30 days for informal resolution. Either party may seek immediate temporary or injunctive relief when reasonably necessary to address intellectual-property misuse, unauthorized distribution, fraud, or an account-security threat.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules, except where the law of a customer's residence provides nonwaivable protections. Subject to those protections, unresolved disputes will be brought in a state or federal court with jurisdiction serving DeKalb County, Georgia.

19 Changes to these Terms

We may update these Terms to reflect changes in law, services, technology, or business practices. Material changes will be communicated by reasonable notice, such as email or an account notice, before they take effect when required. The effective date at the top identifies the current version. Continued use after an update takes effect constitutes acceptance to the extent permitted by law; if you do not agree, you may cancel before the change applies.

20 General provisions

If a provision is found unenforceable, it will be limited or removed only to the extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign or transfer your membership or rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of the business or relevant assets.

These Terms, the applicable Offer terms, the Privacy Policy, and any separately signed agreement constitute the agreement concerning the services. Headings are for convenience only. Obligations concerning ownership, prohibited use, submitted materials, payment obligations, disclaimers, liability, indemnification, disputes, and provisions that by their nature should survive will remain effective after access ends.
